Property Settlement | Sunshine Coast

Andrew Gardiner Law

Do you need straightforward property settlement advice on the Sunshine Coast? You’ve come to the right place.

Property settlement refers to the division of assets and liabilities following the dissolution of a marriage or a de facto relationship. Dividing assets can be daunting if the parties don’t agree on how to proceed.

Our property settlement experts will give you solid legal advice to help you navigate the process and obtain a fair and favourable outcome.

A property settlement may include:

  • Money (cash and in bank accounts)
  • Investments
  • Shares
  • Real estate
  • Inheritances
  • Superannuation
  • Cars, furniture and other assets
  • Insurance policies
  • Credit cards debts, loans, mortgages and personal debts

The notion that assets are split 50/50 is a misconception. Many factors come into play, including what each person contributed to the relationship, how much each person is likely to earn in the future, who will care for the children, the age and health of each person and the length of the relationship.

We can help you achieve the best possible result in your property settlement. Contact us today for a free initial phone consultation and quote.

Property Settlement | Client Case Studies

Our client and her partner were separating. The only major asset was their house, but they did also have a child together.

Due to the financial position of the parties, we negotiated a settlement with the partner whereby our client received a larger share of the property pool as payment of child support. The negotiation included an informal child support agreement that gave both parties flexibility and took their financial situations into consideration.

Our client had separated from her husband and was seeking a transfer of the marital property to herself.

Her husband had built up a property portfolio prior to the relationship and the parties intended for him to keep those properties. The wife did not claim any of her husband’s property or other assets.

We assisted the parties and provided advice to ensure the best outcome. The parties chose to finalise their agreement via a binding financial agreement that provided the required flexibility.
